These terms cover use of hiirecreative.com, the HiiRE Creative candidate portal and the HiiRE Creative client portal.

HiiRE Creative is a trading name of Hiire Ltd, registered in England and Wales, company number [to be added], registered office 2 Bridgewater Court, Little Gaddesden, Hertfordshire, HP4 1PX.

By registering or using the portals, you agree to these terms. Our privacy policy forms part of them.

What we do

We are a recruitment agency. We introduce creative professionals to companies hiring them, for permanent, contract and freelance work.

We are an employment agency and an employment business within the meaning of the Employment Agencies Act 1973 and associated regulations.

We are not your employer. Where a placement is made, the working relationship is between the candidate and the client, or through whatever payroll or limited company arrangement is agreed for contract work.

For candidates

It is free.

We never charge candidates. Not to register, not to be put forward, not to be placed.

Give us accurate information.

Your CV, work history and availability should be true. If something changes, tell us. We will not knowingly put forward information we know to be wrong, and we may end our relationship with you if we find it is.

We ask before we act.

We will not share your details with a client without your agreement. We will not contact a referee without telling you first.

Your account.

Keep your login details to yourself. Tell us if you think someone else has access.

Registration is not a guarantee.

We are selective about who we represent, and we cannot promise interviews, roles or placements. If we do not have anything suitable, we will keep you on the network unless you ask us not to.

What you upload.

You keep ownership of your CV and portfolio. By uploading them you give us permission to use them for recruitment purposes: reviewing your suitability, writing your profile, and discussing you with clients once you have agreed.

For clients

Registration and approval.

Client accounts are reviewed before activation.

Give us a true brief.

The role, the salary or rate, the working arrangement and the process should be as described. A brief that turns out to be materially different wastes everyone's time, including candidates'.

Use the data for the role.

Candidate information we share with you is for assessing that candidate for the role in question. Do not pass it to third parties, add it to your own database for other purposes, or approach the candidate outside the process without telling us.

Feedback.

We ask for a decision and a reason within a reasonable time. Candidates deserve an answer.

Introductions.

Once we introduce a candidate to you, that introduction stands. If you engage them within twelve months of the introduction, whether for the role we discussed or another one, our fee applies. This includes engaging them through another agency, directly, or through a related company.

Fees

Fees are agreed in writing before we start work on a role.

Permanent placements: a percentage of the candidate's first-year salary package, invoiced on the candidate's start date, payable within the agreed terms.

Contract and freelance placements: a margin on the day rate, invoiced periodically for the duration of the engagement.

VAT is charged in addition where applicable.

Late payment may attract interest under the Late Payment of Commercial Debts (Interest) Act 1998.

Rebates.

Where a permanent placement ends within a defined period after the start date, a rebate may apply on a sliding scale. The applicable terms are set out in the fee agreement for each role. Rebates do not apply where the role was made redundant, where the client changed the role materially, or where fees remain unpaid.

What we can and cannot promise

We take reasonable care in selecting and introducing candidates. We check what we reasonably can, we take references where agreed, and we tell you honestly what we know.

We cannot guarantee that any candidate will be suitable, will accept an offer, will stay, or will perform as expected. Assessing and deciding whether to engage someone remains the client's responsibility, including any checks specific to the role such as right to work, professional registration or qualifications.

We do not carry out background screening, credit checks or security vetting. If your role requires those, arrange them separately.

Liability

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

Otherwise, our total liability in connection with any role is limited to the fees paid to us for that role, or £1,000, whichever is greater.

We are not liable for indirect or consequential loss, loss of profit, loss of business, or the performance or conduct of any candidate once engaged.

Accounts

We may suspend or close an account where these terms are breached, where information given is materially inaccurate, or where behaviour towards candidates, clients or us is unacceptable.

Either side can stop using the service at any time. Fees already due remain payable.

Intellectual property

The platform, the website and their content belong to us. Candidate CVs and portfolios belong to the candidate.

Changes

We may update these terms. Material changes will be notified by email or in the portal.

Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
